Smoking in United States of America

In the United States of America, smoking is allowed but tobacco products should follow some regulations. Under these regulations, health warnings on tobacco packaging including cigarettes are mandatory, the minimum legal age for their sales is 21 years, and there are no federal legal restrictions on smoking in public places. While tobacco advertising is regulated, not all forms of their advertising are banned. An excise tax of 32.16% with a total taxation rate of 37.36% is applied on cigarettes. Cigarettes can legally be sold with authorised documents. They may also be purchased through vending machines as well as through online channels. Importing cigarettes for trade is allowed with an appropriate import license. Despite these control measures, prevalence data show that smoking remains an important public health issue in the United States. There were 39.8 million current smokers in the country in 2024. This represents an overall adult smoking prevalence of 14.1%, with higher prevalence among men (17.1%) than among women (11.1%). In comparison, the overall current smoking prevalence was 12.3% in 2022. The adult daily smoking prevalence was recorded to be 10.01% in 2020. Smoking-related mortality also remains significant in the country. In 2021, smoking resulted in 360,370 deaths, including 216,986 male deaths and 143,383 female deaths. This shows that smoking accounted for 10.38% of all deaths in the United States in 2021, with a higher rate among men (11.9%) than among women (8.7%).

San Jose Bans Menthols

Local news media outlets indicate that the city council for San Jose, Calif., has opted to ban the sale of flavored tobacco products within city limits. Such a ban covers flavored vaping products regardless of their FDA approval status and the flavors of menthol and mint characterized combustible cigarettes.

This means that San Jose is the largest city in California and the entire United States to adopt a prohibition on flavored tobacco.

“I think it’s an important first step to making sure we keep these very dangerous, very addictive products not only out of the hands of our children but really off of their radar,” said Magdalena Carrasco, [...]

Big Tobacco comes out swinging against Biden’s Build Back Better bill

A group tied to major cigarette manufacturers is warning Congress that if lawmakers tax tobacco to help pay for President Joe Biden’s domestic agenda, suppliers will market smokes to children.

That was the not-so-subtle message made last month by a coalition of trade associations, including the National Association of Convenience Stores, as Congress began hammering out the specifics of the president’s Build Back Better bill.

Dr. Richard Feldman: Taxing e-cigarettes is the right move

Electronic-cigarette use is at epidemic proportions. Most concerning is the exponential increase among youth. Although there has been some recent decline in e-cigarette use among high school students, use increased 135% from 2017 to 2019. Currently, nearly 20% of high school students partake in “vaping” with these electronic nicotine-delivery devices. Youth e-cigarette use is actually now higher than tobacco use.

The FDA’s Bias Against The Vape Industry Emerges During The PMTA Process

Sadly, following the FDA’s September 9 deadline to decide which vaping products are fit to be kept on the market, and which ones must go, it is becoming clear that the agency is biased against the products.

Despite shifting the PMTA deadline back and forth numerous times, leaving the smaller vape companies unprepared, over 500 businesses (most of which are small) managed to meet the deadline. In total, over 6.5 million Premarket Tobacco Applications were submitted, one for each product from every brand and any slight variation of it.

Thousands of unknown chemicals and substances found in e-cigarettes

Vaping aerosols contain thousands of unknown chemicals and substances not disclosed by manufacturers, including industrial chemicals and caffeine, Johns Hopkins University researchers found.

The study is the first to apply to vaping liquids and aerosols an advanced fingerprinting technique used to identify chemicals in food and wastewater. The results, just published in the journal Chemical Research in Toxicology, suggest people who vape are using a product whose risks have yet to be fully determined and could be exposing themselves to chemicals with adverse health effects.

How Can We Integrate Nicotine Into Harm Reduction Programs?

Vaping and forms of smokeless tobacco have gained popularity as harm reduction options for millions of ex-smokers around the world. Evidence shows that such products are both vastly safer than cigarettes and effective ways of quitting them. But in the last few years, we have simultaneously seen a dramatic increase in fear-mongering around these options, led by national and local governments, well funded nonprofits and the World Health Organization.

Philip Morris International Inc. and partner Altria Group Inc. will be barred from importing the IQOS heated-tobacco sticks into the U.S. after they lost a legal battle with British American Tobacco Plc before a U.S. trade agency. Philip Morris pledged to challenge what it called a “puzzling” decision.

Philip Morris and Altria infringe two patents owned by BAT’s subsidiary Reynolds American Inc., the U.S. International Trade Commission said in a notice posted on the agency’s website. The import ban -- and an order to stop selling any products already imported -- will take effect in 60 days [...]
