Smoking in United States of America

In the United States of America, smoking is allowed but tobacco products should follow some regulations. Under these regulations, health warnings on tobacco packaging including cigarettes are mandatory, the minimum legal age for their sales is 21 years, and there are no federal legal restrictions on smoking in public places. While tobacco advertising is regulated, not all forms of their advertising are banned. An excise tax of 32.16% with a total taxation rate of 37.36% is applied on cigarettes. Cigarettes can legally be sold with authorised documents. They may also be purchased through vending machines as well as through online channels. Importing cigarettes for trade is allowed with an appropriate import license. Despite these control measures, prevalence data show that smoking remains an important public health issue in the United States. There were 39.8 million current smokers in the country in 2024. This represents an overall adult smoking prevalence of 14.1%, with higher prevalence among men (17.1%) than among women (11.1%). In comparison, the overall current smoking prevalence was 12.3% in 2022. The adult daily smoking prevalence was recorded to be 10.01% in 2020. Smoking-related mortality also remains significant in the country. In 2021, smoking resulted in 360,370 deaths, including 216,986 male deaths and 143,383 female deaths. This shows that smoking accounted for 10.38% of all deaths in the United States in 2021, with a higher rate among men (11.9%) than among women (8.7%).

Push to ban sale of flavored tobacco, vape juices in Denver sparks intense debate

A push to outlaw the sale of flavored smoking products in Denver has drawn Big Tobacco, mom-and-pop vape shops, hookah lounges, health care providers and social justice advocates into a fight over public health, business rights and the freedom of choice.

The proposal under consideration by the Denver City Council is becoming one of the most intensely debated issues in City Hall in recent years, with public health advocates saying a ban would help end the teen vaping crisis while the opposition argues the city would be going too far in restricting access to products that adults have a right to use.

FDA Puts A Second Vape Company Back Under Review

On October 22, the Food and Drug Administration (FDA) put Fumizer’s flavored vaping products back under review—rescinding the denial it had issued in September. [...]

In early September, the FDA issued a marketing denial order (MDO) for Fumizer’s flavored vaping products. The company, like all others in the United States, had until September 2020 to file a premarket tobacco product application (PMTA) in order for its vapes and e-liquids to remain on the marketplace. The FDA, in turn, had until September 2021 to look over the PMTAs, which companies had to submit for every single product they wanted to keep selling.

Backlash Against the FDA Grows as Vape Company Ramps Up Legal Fight

On October 20, My Vape Order (MVO) petitioned a federal court of appeals for “an emergency motion for a stay pending a review and for expedited consideration” on the company’s vapor products that have been removed from the market.

In early September, the Food and Drug Administration (FDA) had issued a marketing denial order for MVO’s products. Like all other vape companies in the United States, MVO had until September 2020 to file premarket tobacco product applications (PMTAs) to be able to keep selling its vapes and e-liquids; the FDA, in turn, had until September 2021 to review the PMTAs.

Jackie Toledo wants to ensure that new vaping law in Florida is being enforced

Tampa-based GOP House Rep. Jackie Toledo says that she was "shocked" recently after she went into a retail store in Tampa that sells e-cigarettes and didn't see any signs informing the public that it’s now illegal for anyone 21 and under to purchase vaping products in the Sunshine State. “I know that they were selling to minors because someone had told me that they had purchased something there and I wanted to make sure that they would comply,” says Toledo, who co-sponsored legislation during the 2021 session that raised the legal age to buy tobacco and nicotine products in Florida from 18 to 21, complying with federal law.

FDA Reshapes Vape Category

On Aug. 26, the Food and Drug Administration (FDA) lowered the hammer on approximately 35,000 flavored e-cigarette items by issuing marketing denial orders (MDOs). The ruling prohibits interstate commerce for these products, resulting in convenience stores, vape shops and tobacco retailers immediately pulling them from store shelves.

One week later, the FDA released approximately 300,000 more MDOs on flavored vape and e-cigarette products. Then, on the court-mandated deadline of Sept. 9, the FDA stated it had taken action on approximately 93% of the more than 6.5 million pre-market tobacco applications (PMTAs) accepted, [...]

Confusion clouds FDA’s approach to e-cigarettes

The Food and Drug Administration’s decision this week to authorize the sale of an electronic cigarette was a landmark for the vaping industry — but it may only deepen confusion about the sector’s future.

More than a month after a court-ordered deadline to determine which e-cigs could stay on the market, FDA has yet to act on applications from some of the industry’s biggest players, including Juul. And while the agency has denied or rejected as incomplete millions of marketing applications from small and mid-sized manufacturers, it has not said whether any type of vape flavors are acceptable. FDA’s First-Ever Vaping Product Authorization Brings Mixed Feelings

On October 12, the Food and Drug Administration (FDA) authorized the first-ever vaping product to legally be sold in the United States.

The FDA determined that the Vuse Solo, along with two “tobacco”-flavored e-liquid cartridges, were “appropriate for the protection of public health”—meaning the agency believed that the products were more likely to help adult smokers switch to a safer alternative than to introduce a new generation to nicotine. The decision is historic, but leaves advocates on both sides of the raging vaping debate dissatisfied.

F.D.A. Authorizes E-Cigarettes to Stay on U.S. Market for the First Time

The Food and Drug Administration for the first time on Tuesday authorized an electronic cigarette to be sold in the United States, a significant turn in one of the most contentious public health debates in decades.

In greenlighting a device and tobacco-flavored cartridges marketed by R.J. Reynolds under the brand name Vuse, the agency signaled that it believed that the help certain vaping devices offer smokers to quit traditional cigarettes is more significant than the risks of ensnaring a new generation.

“The authorized products’ aerosols are significantly less toxic than combusted cigarettes based on available data,” the F.D.A. said in a statement announcing the decision.
