Smoking in United States of America

In the United States of America, smoking is allowed but tobacco products should follow some regulations. Under these regulations, health warnings on tobacco packaging including cigarettes are mandatory, the minimum legal age for their sales is 21 years, and there are no federal legal restrictions on smoking in public places. While tobacco advertising is regulated, not all forms of their advertising are banned. An excise tax of 32.16% with a total taxation rate of 37.36% is applied on cigarettes. Cigarettes can legally be sold with authorised documents. They may also be purchased through vending machines as well as through online channels. Importing cigarettes for trade is allowed with an appropriate import license. Despite these control measures, prevalence data show that smoking remains an important public health issue in the United States. There were 39.8 million current smokers in the country in 2024. This represents an overall adult smoking prevalence of 14.1%, with higher prevalence among men (17.1%) than among women (11.1%). In comparison, the overall current smoking prevalence was 12.3% in 2022. The adult daily smoking prevalence was recorded to be 10.01% in 2020. Smoking-related mortality also remains significant in the country. In 2021, smoking resulted in 360,370 deaths, including 216,986 male deaths and 143,383 female deaths. This shows that smoking accounted for 10.38% of all deaths in the United States in 2021, with a higher rate among men (11.9%) than among women (8.7%).

Why safer vaping devices that don't explode will not be available in the U.S.

The first vaping products designed to prevent fires and explosions — and safety certified by UL — are scheduled to hit the market in a few weeks. While these redesigned electronic cigarettes will be available in Canada, they won’t be sold in the United States.

The vaping industry blames the U.S. Food and Drug Administration, which regulates tobacco products, for preventing Americans from buying these safety-enhanced devices.

State may crack down on flavored e-cigarettes

State Health Commissioner Howard Zucker is promising a sweeping crackdown on flavored e-cigarettes that are marketed to teens, as pressure mounts for New York to ban the sweetened nicotine products.

“We are concerned about this. There’s a lot of marketing to children of this and we need to tackle it,” Zucker told the Public Health Council on Oct. 11.

Vaping company Juul’s products come in flavors such as mango, mint, and crème brûlée, which critics say are aimed at kids.

Professor collects cigarette butts to bring to President Tripathi

If you walk across campus, it’s no secret that the Smoke Free UB Policy isn’t enforced.

Outside Lockwood Library, Capen Hall or pretty much any building on North Campus, countless students, faculty and staff smoke cigarettes throughout the day. Since UB is technically a smoke-free campus, there are no receptacles to throw away butts and thousands of finished cigarettes are littered across campus.

These Two States Are Poised To Be The Next Big Marijuana Markets

With federal prohibition still alive and well despite record public support for marijuana legalization, the cannabis industry in the United States remains a state-by-state business. The inability to cross state lines has led to a web of complex and disparate state laws and regulations for businesses to navigate. This forces cannabis producers to recreate their entire infrastructure in every new state, rather than scaling up production and shipping products across the country, [...]

E-Cigarettes Face FDA Backlash

At midnight on Aug. 23, the second tranche of President Trump’s tariffs officially took effect, levying a 25% tax on 279 products from China, including electronic nicotine delivery systems (ENDS). While politicians, pundits and economists argue about the diplomatic and trade value of such actions, convenience store and vape shop owners and operators brace for the probable financial fallout.

“It definitely will have an effect on profit margins, but to what extent I’m not sure yet,” said Tim Greene, [...]

Sorry Smokers, There is No Such thing as Safe E-Cigarettes

Multiple studies completed over the past several years indicate several health issues associated with vaping and smoking an e-cigarette. When e-cigarettes hit the market in 2006, companies assured the FDA the products were safe for consumption. They believed the product safety based on the fact that ingredients used in their product were already FDA approved. However, studies completed indicate the products damage the lungs and increase the risk of heart attack in users.

Juul boosts lobbying amid FDA scrutiny

E-cigarette maker Juul is ramping up its Washington lobbying operation as it tries to head off potential regulatory threats from the Trump administration and Congress.

The company has been under scrutiny from Food and Drug Administration (FDA) regulators and lawmakers from both parties amid a massive surge in popularity for its products among teens. Juul says e-cigarettes provide a healthier alternative for adult smokers and are an important tool to help wean them off traditional tobacco products. [...]

Nearly 2 million U.S. adult nonsmokers vape

Nearly 2 million U.S. adults who have never consistently smoked traditional cigarettes use e-cigarettes, according to results from a national survey. Of these sole e-cig users, about 60 percent are young adults, aged 18 to 24, researchers report [...] E-cigarette companies have marketed the devices — which heat and vaporize liquids that typically contain nicotine — as a way to help adults quit smoking. But some public health officials worry that e-cigarettes could become a means to nicotine addiction, rather than an end.

OPINION: California is overtaxing a public health necessity: e-cigarettes

According to the Center of Disease Control, cigarettes are responsible for about 480,000 deaths each year in America, [...] If only there were a solution — some sort of nifty alternative that delivers nicotine in the same manner as a cigarette without harmful chemicals.

Fortunately, the epidemic of tobacco-related illness and death does have a perfectly viable, and already existing, solution: the Juul. California shouldn’t be taxing Juuls to the point where they’re no longer accessible to people who need them most.

NU Medicine warns against treating e-cigarettes like cigarettes

Assuming e-cigarettes are equal to cigarettes could lead to misguided research and policy initiatives, a report of the Northwestern University (NU) Medicine said.

"Comparing cigarettes to e-cigarettes can give us a false sense of what dangers exist because it misses the gap in understanding how people use them and how they can make people dependent," said first author Matthew Olonoff, a doctoral student at NU Feinberg School of Medicine.
