Smoking in United States of America

In the United States of America, smoking is allowed but tobacco products should follow some regulations. Under these regulations, health warnings on tobacco packaging including cigarettes are mandatory, the minimum legal age for their sales is 21 years, and there are no federal legal restrictions on smoking in public places. While tobacco advertising is regulated, not all forms of their advertising are banned. An excise tax of 32.16% with a total taxation rate of 37.36% is applied on cigarettes. Cigarettes can legally be sold with authorised documents. They may also be purchased through vending machines as well as through online channels. Importing cigarettes for trade is allowed with an appropriate import license. Despite these control measures, prevalence data show that smoking remains an important public health issue in the United States. There were 39.8 million current smokers in the country in 2024. This represents an overall adult smoking prevalence of 14.1%, with higher prevalence among men (17.1%) than among women (11.1%). In comparison, the overall current smoking prevalence was 12.3% in 2022. The adult daily smoking prevalence was recorded to be 10.01% in 2020. Smoking-related mortality also remains significant in the country. In 2021, smoking resulted in 360,370 deaths, including 216,986 male deaths and 143,383 female deaths. This shows that smoking accounted for 10.38% of all deaths in the United States in 2021, with a higher rate among men (11.9%) than among women (8.7%).

Why Do Some Traditional Cigarette Users Switch to Vape?

Electronic cigarettes first arrived on the U.S. retail scene in 2006, and since then, this other tobacco product (OTP) segment has gained a substantial customer base within the convenience store channel.

The addition of open-system vaporizers and pod devices further expanded inventory selection of electronic nicotine delivery systems (ENDS). Early on, ENDS of all types primarily appealed to a younger clientele, especially millennials and, eventually, Generation Z. While that continues to hold true to a degree, another trend revealed itself as consumers became more aware of the OTP: some traditional cigarette users switched to vape.

FDA’s Vaping Regulations Survive as Supreme Court Rejects Appeal

The U.S. Supreme Court rejected a challenge to the Food and Drug Administration’s regulation of electronic cigarettes and vape pens, turning away an opportunity to put broad new restrictions on the power of federal administrative agencies.

The appeal by a Mississippi vape shop and an industry trade group sought to invoke the so-called non-delegation doctrine, a sparingly used constitutional rule that says Congress must give clear guidance to an agency before handing off its legislative responsibilities.

San Francisco’s Vape Flavor Ban Saw More Teens Start Smoking

In the summer of 2018, San Francisco residents voted overwhelmingly to ban the sale of flavored nicotine vaping products (as well as flavored tobacco products, including menthol cigarettes). By January 2019, when the prohibition took effect, almost every retailer in the city was immediately compliant. It had been an expensive fight, with companies that sell vaping products spending tens of millions of dollars on one side and billionaire Michael Bloomberg, a longtime anti-smoking funder who has since turned his abstinence-only approach to vaping, bankrolling the opposition with millions of his own.

How Juul founders’ dream to disrupt Big Tobacco left teens hooked on vaping

In 2018, Caleb Mintz sensed something wasn’t right about a presentation given at his school, the renowned Dwight School on the Upper West Side.

Someone had been brought in to supposedly teach Mintz, then a ninth-grader, and his classmates about the dangers of tobacco and vaping. But the speaker had been sent by Juul Labs, the company behind the discreet vaping device that Mintz and nearly all of his friends had tried.

Health chief warns of kid pot dangers as NY readies for legal weed

The city Health Department wants kids to beware of reefer madness.

The agency recently warned doctors about the potential dangers of youths smoking weed and other substances — less than two months after the state green-lit recreational marijuana for adults 21 and up.

In an email blasted out last week to city doctors and public health officials, DOH chief medical officer Dr. Michelle Morse described a troubling uptick in kids puffing on pot, e-cigarettes and hookah.

US MENTHOL BAN – BENEFIT OR BAD MOVE

As the US Food and Drug Administration takes steps to ban them, menthol cigarettes and flavored cigars might soon become a thing of the past. This action is being taken to try to prevent addiction and save lives, but why flavored tobacco, specifically menthol? The simple answer is that it’s much more addictive than non-flavored tobacco, but the issue goes much deeper. The evidence is becoming irrefutable as more and more studies release their findings; compared to unflavored tobacco, it’s easier to get addicted to menthol cigarettes and harder to quit them. [...]

Oregon lawmakers close loophole used for underage purchases of nicotine vapes

Oregon Attorney General Ellen Rosenblum on Wednesday applauded Oregon lawmakers for passing legislation that will close a loophole allowing underage Oregonians to purchase vaping products over the internet. Under House Bill 2261, all nicotine vaping devices and components will no longer be able to be sold online. “There is no effective way to verify an age or stop minors from purchasing these products over the internet,” Rosenblum said in a press statement. “In Oregon, you cannot buy cigarettes online, and there is no good reason to be able to buy vape products online either.”

Big Tobacco Hooked Black Americans On Menthols. Now It Fights Ban As Racial Injustice.

The tobacco industry has a long, well-documented history of targeting Black Americans with menthol cigarette advertisements, and the result is that nearly 85% of Black smokers use tobacco with the minty flavor additive.

Following years of delay, the Food and Drug Administration last month proposed a nationwide ban on the sale and production of menthol cigarettes. As the effort to get menthol smokes off the market gained momentum in recent years, the industry sidled up to Black-led organizations and Black lawmakers. [...]

The Weak, Unconvincing Case Against Vaping

In April 1994, the heads of the biggest tobacco companies testified before Congress that cigarettes weren’t addictive. [...] In 1998, the four largest tobacco companies in the U.S.—Philip Morris, R.J. Reynolds, Brown & Williamson, and Lorillard—entered the Tobacco Master Settlement Agreement with 46 attorneys general, requiring the industry to shell out hundreds of billions of dollars in perpetuity so states could grapple with climbing medical costs associated with smoking-related illnesses.
