Dutch court upholds e-cigarette flavor ban
A Dutch court has upheld the government's ban on sweet flavors for e-cigarettes, stating they attract young people to smoke. British American Tobacco's appeal against the ban was rejected. The court deemed the flavor ban lawful due to e-cigarettes' harmfulness and appeal to youth. The argument that the ban hinders smoking cessation efforts was dismissed, as e-cigarettes with tobacco flavor remain available. This decision allows smokers to switch to tobacco-flavored e-cigarettes under the ban.

Dutch Court Upholds E-cigarette Flavour Ban
A Dutch court upheld the government’s ban on sweet flavors for e-cigarettes on Wednesday, citing their appeal to young people and the associated health risks. British American Tobacco (BAT) had challenged the ban, claiming it infringed on the free movement of goods and could deter smokers from switching to e-cigarettes as a quitting aid. The court rejected BAT's arguments, stating that tobacco-flavored e-cigarettes are still available, allowing smokers to continue using e-cigarettes to quit traditional smoking within the restrictions.

Dutch Flavour Ban Impact
A survey by Dutch vaper group ACVODA reveals that the online sales and flavour ban in the Netherlands has led to 80% of vapers buying products from nearby countries where flavoured items are legal. The ban has not changed usage patterns, with only 2% switching to mandated tobacco flavour and about 10% returning to smoking. Vapers criticize the government for limiting access to safer alternatives and forcing them towards cigarettes. The study shows resistance to quitting among e-cigarette users, with almost half feeling the government obstructs access to harm-reducing options. Concerns are raised about the ban's unintended consequences and the need for better policy alignment with users' needs.

Philip Morris gets round Dutch flavoured tobacco ban
Philip Morris is bypassing the ban on flavored tobacco in the Netherlands by launching Levia, a nicotine product made from cellulose. Priced at €6.60 for a pack of 20 sticks, available in menthol and berry flavors, they are used in a vape-like device. Critics warn that although Levia is tobacco-free, it contains addictive nicotine, with unknown long-term health effects. Concerns arise as it may lead to continued smoking. The Dutch authorities cannot act due to current regulations but may change them soon. Trimbos research shows a concerning number of Dutch youth vaping and smoking, dispelling the idea that vaping deters smoking among youngsters.

Dutch wait for EU tax on e-cigarettes plan, despite health fears
The Dutch government has no plans to introduce a tax on e-cigarettes, or vapes, and will leave the issue up to the new administration after the November election, the Telegraaf reported on Monday. The Netherlands is waiting for the green light from the EU to start taxing e-cigarettes and that is likely to take several years, the paper said. In the meantime, other EU countries have introduced their own local taxes and the Netherlands has done the same for other unhealthy products, such as of soft drinks, the paper points out.
