Smoking in United States of America

In the United States of America, smoking is allowed but tobacco products should follow some regulations. Under these regulations, health warnings on tobacco packaging including cigarettes are mandatory, the minimum legal age for their sales is 21 years, and there are no federal legal restrictions on smoking in public places. While tobacco advertising is regulated, not all forms of their advertising are banned. An excise tax of 32.16% with a total taxation rate of 37.36% is applied on cigarettes. Cigarettes can legally be sold with authorised documents. They may also be purchased through vending machines as well as through online channels. Importing cigarettes for trade is allowed with an appropriate import license. Despite these control measures, prevalence data show that smoking remains an important public health issue in the United States. There were 39.8 million current smokers in the country in 2024. This represents an overall adult smoking prevalence of 14.1%, with higher prevalence among men (17.1%) than among women (11.1%). In comparison, the overall current smoking prevalence was 12.3% in 2022. The adult daily smoking prevalence was recorded to be 10.01% in 2020. Smoking-related mortality also remains significant in the country. In 2021, smoking resulted in 360,370 deaths, including 216,986 male deaths and 143,383 female deaths. This shows that smoking accounted for 10.38% of all deaths in the United States in 2021, with a higher rate among men (11.9%) than among women (8.7%).

It’s only been one day since the U.S. Food and Drug Administration’s anti-vaping regulation went into effect and already the FDA has informed some stakeholders that their Premarket Tobacco Applications have been received and accepted for review by the regulator.
Is there truly a glimmer of hope for the survival of the U.S. vaping industry or do vapers have a dark future to face?

If there’s anyone who might know the answers, it’s Dimitris Agrafiotis a.k.a. the VapinGreek. He’s a globally known vaping advocate and executive director of the Tennessee Smoke Free Association. [...]

Dear U.S. Vapers: “This Is Not The End”

Under the Tobacco Control Act of 2009, the PMTA regulatory pathway is a mandatory process that the U.S. Food and Drug Administration (FDA) must enforce due to the need to protect the public health in the most scientifically-focused manner possible. The PMTA deadline was initially well-intentioned, but the law turned into a morass of bureaucratic red-tape that truly places innocent lives at risk. But, what happened to the so-called transparency of government and the equitable treatment of people, services, goods, and beliefs under the banner of tolerance and freedom?

Teenage E-Cigarette Use Falls While Flavors Remain Popular

Teenagers’ e-cigarette use declined this year, according to an influential annual survey, marking a positive trend that health officials say still leaves the number of users too high.

In 2020, 19.6% of high-school students and 4.7% of middle-school students said they vaped, according to the National Youth Tobacco Survey, [...] “Although the decline in e-cigarette use among our nation’s youth is a notable public health achievement, our work is far from over,” CDC Director Robert Redfield said in a statement. About 3.6 million youths reported using e-cigarettes within the prior 30 days, down from 5.4 million in the 2019 survey.

Almost 14 million U.S. adults vape, with use rising fastest in young

The number of Americans using electronic cigarettes is soaring, especially among youth, a new study finds.
Nearly 14 million U.S. adults vaped in 2018, up from just over 11 million adults in 2016. The increase was seen in all socioeconomic groups, the researchers found.

"An increasing number of individuals are using e-cigarettes, especially in the younger age groups, which suggests that more individuals are becoming addicted to e-cigarettes rather than just experimenting with them, making the increased uptake among tobacco-naive individuals even more concerning," said lead researcher Dr. Olufunmilayo Obisesan. A study published in JAMA Pediatrics reported that almost half of teens who vape e-cigarettes seriously contemplate quitting, suggesting that interventions focused on vaping cessation are “urgently needed,” researchers said.

Tracy T. Smith, PhD, an assistant professor of psychiatry and behavioral sciences at the Medical University of South Carolina, and colleagues assessed national survey results from 14,798 children aged between 12 and 17 years, including 498 (3.6%) who smoked an e-cigarette within the past 30 days.

FDA Will List Which E-Cigarette Makers Applied to Stay on Market

Regulators plan to open up a process that’s normally secretive by listing which e-cigarette makers want permission to sell their products in the U.S., a move that could help consumers and retailers spot illegal products more easily.

The Food and Drug Administration now plans to publish a list of all the products subject to the agency’s Sept. 9 deadline, and which have filed applications, Mitch Zeller, director of the FDA’s Center for Tobacco Products, said in a blog post Monday. [...]

California Ramps Up the War on Vaping With Flavor Ban

They never stop. Tobacco control organizations in California convinced the California Assembly to pass SB 793 on August 24, after the Senate had already done so. The bill bans the sale of flavored vaping products in brick-and-mortar businesses. It also outlaws sales of flavored smokeless tobacco, small cigars and menthol cigarettes. Flavored hookah products, pipe tobacco and premium cigars are exempt.

The mainstream media predictably played their part, with headlines like, “California must ignore Big Tobacco’s attacks and protect kids from flavored nicotine.” [...]
