Two More California Cities Preparing To Ban Flavored Tobacco and Vape Products

After San Francisco banned adults from purchasing flavored tobacco and vaping products in 2018, a funny thing happened. Teen smoking rates increased.

Now, two other major California cities are considering similar bans. Like San Francisco's, the proposed measures in Los Angeles and San Jose are backed by vocal advocates who argue that candy- and fruit-flavored electronic cigarettes and tobacco products (which minors are already prohibited from legally purchasing) are tempting kids to get addicted to nicotine. The Vaping Industry as We Know It May Soon Disappear

For the last 15 years, there’s been a caveat tacked on to any discussion of e-cigarettes’ public health impact. Though millions of people in the U.S. use them regularly, the devices have never been authorized by the U.S. Food and Drug Administration (FDA).

That could change next week, as the multi-billion-dollar vaping industry nears its judgement day. The FDA is supposed to decide by Sept. 9 whether and how e-cigarette companies—including market-leader Juul Labs—may keep selling their products in the U.S. The long-awaited decisions promise to spark controversy no matter which way they go.

The FDA Denies 800 More Flavored Vaping Products. Is This a Pattern?

On August 31, the Food and Drug Administration (FDA) denied the PMTA applications for about 800 vaping products from three e-liquid manufacturers. All of the products were flavored.

Dimitris Agrafiotis, the self-described “Vapin’ Greek” who runs International Vapor Solutions, a consultancy firm, told Filter that three e-liquid companies companies he represents—two of them large and one medium-sized—were sent marketing denial orders (MDOs) by the agency.

Pot Industry Vexed to Be Pulled Into Congress’ Vaping Rules

Cannabis businesses are fearful a congressional mandate lumping them in with tax and shipping restrictions meant for nicotine vaping devices could change their legal treatment forever, resulting in more headaches, and bigger bills.

The Prevent All Cigarette Trafficking Act imposes arduous registration requirements, strict noncompliance fines, and shipping bans. The law’s definition of liquid vaporizers is ambiguous, calling them electronic devices that deliver nicotine, flavor, or “any other substance” via an aerosolized solution. This categorization likely ropes the e-liquids made by the cannabis industry into the law, industry watchers say; [...]

Lawmakers’ Pressure On FDA Review Of New Tobacco Products Blurs Line Between Oversight And Undue Influence

Food and Drug Administration (FDA) leadership and staff are accustomed to external criticism and pressure. After all, FDA-regulated products account for 20 cents of every dollar spent by American consumers, so criticism comes with the job. Over the past year, the volume of noise aimed at FDA over one particular duty—its review of applications for electronic nicotine delivery systems (ENDS) and other “deemed” new tobacco products—has been dialed to 11.

Pressure has come from a variety of voices and in different forms. [...]

Denied FDA Authorization, Vaping Companies Start to Explore Loopholes

On August 26, the Food and Drug Administration (FDA) denied the first marketing applications for about 55,000 flavored e-cigarette products from three small companies. Earlier in August, the FDA refused to file some 4.5 million product applications from JD Nova, citing that the company had failed to include an adequate environmental assessment for those products. It was largely a bureaucratic technicality to allow the agency to dismiss those applications without fully considering any corresponding scientific or behavioral data that may have been included.

Top Tobacco Control Experts Endorse Vaping

Dr. Kenneth Warner [...] has published a research review in the peer-reviewed American Journal of Public Health endorsing vaping as a less risky alternative to the smoking of combustible tobacco cigarettes.

Filter Magazine reports that Warner, with some of the most respected nicotine use addiction and tobacco researchers in the United States, has opted to endorse vaping and smoke-free nicotine delivery as a potential strategy to eliminate cigarettes. “Our concern is that much of the public health community—certainly the media, and very much legislators—haven’t really heard the other side of the story,” Warner told Filter reporters.

Anti-Tobacco Scientists Warn Benefits of E-Cigarettes Are Being Lost

The potential of electronic cigarettes to save millions of lives is being lost because of the media, public health groups, and politicians' near singular focus on youth vaping to the detriment of adult smokers. That's according to a new paper written by 15 past presidents of the Society for Research on Nicotine and Tobacco (SRNT).

SRNT is the world's largest professional organization dedicated to studying tobacco, nicotine, and their effects on public health. For decades, SRNT has been instrumental in advancing anti-tobacco policies.

Fortunes Tied | Cannabis Industry Joins Vape Mail Fight

The “Vape Mail” ban could have a devastating impact on the nicotine vaping industry in the United States. But it also threatens another industry, one more popular and on the rise: the cannabis industry. It appears lawmakers intend to sweep cannabis vaping products into the new regulation.
In this episode of RegWatch, we are joined by Tami Wahl, Washington lobbyist for the cannabis industry. She’s leading an effort to fight the Vape Mail ban that includes cannabis vaping and nicotine vaping industries. [...]

Vapes Outperform NRT for Smokers Who Have Tried Past Quitting Aids

For people who want to stop or reduce their smoking and have previously been unable to do so using conventional treatments, e-cigarettes are much more effective than nicotine-replacement therapy (NRT), according to new research.

study published in Addiction assessed the efficacy of e-cigs compared to NRT among smokers who had tried previous treatments, including NRT. It was conducted as a follow-up to an earlier study by many of the same researchers, which found vapes to be more effective than NRT for smoking cessation among people who hadn’t previously tried any treatments.
