Juul Gets Temporary Reprieve to Keep Selling Its E-Cigarettes

A federal appeals court on Friday granted a temporary reprieve to Juul Labs that will allow it to keep its e-cigarettes on the market, pending further court review of a decision just a day earlier by the Food and Drug Administration to ban sales of the company’s products.

The United States Court of Appeals for the District of Columbia issued a temporary stay that had been sought by Juul. The brief order by the appeals court cautioned that the stay was “ should not be construed in any way as a ruling on the merits.”

Juul to Be Removed From US Vape Market by the FDA, Reports Say

The FDA is planning to deny the marketing applications for Juul, reports The Wall Street Journal, which would pull one of the most popular e-cigarettes off the US market.

Filter has been unable to independently confirm the news. The FDA has not responded to request for comment, and so far offered no reason for the alleged denial. Juul also did not respond to a request for comment by publication time. Mitch Zeller, the former director of the Food and Drug Administration’s Center for Tobacco Products (CTP), declined to comment over email.

AHA Urges Immediate Action to Curb Vaping Among Youth

Action is needed now to reduce or prevent adolescents from accessing and using electronic cigarettes, the American Heart Association (AHA) concludes in a new scientific statement. Current scientific evidence indicates that use of these vaping products has harmful effects on health that can accrue over time, leading to an increased risk for cardiovascular and pulmonary disease in long-term users, the writing group says. "Inhaling any foreign substance can have effects on the respiratory and cardiovascular systems," writing group chair Loren E. Wold, PhD, Ohio State University College of Medicine, Columbus, says in an AHA news release.

Advocates cautiously optimistic over report of Juul ban

Anti-smoking advocates said they are cautiously optimistic following a report that the Food and Drug Administration (FDA) is preparing to remove Juul’s vaping products from U.S. shelves.

The move from FDA, as reported Wednesday by The Wall Street Journal, would bring an end to the two-year review of the company’s request to sell tobacco and menthol flavored e-cigarettes.

If the report is true, “it’s most welcome and long overdue,” said Erika Sward, American Lung Association’s national assistant vice president of advocacy.

FDA to Order Juul E-Cigarettes Off U.S. Market

The Food and Drug Administration is preparing to order Juul Labs Inc. to take its e-cigarettes off the U.S. market, according to people familiar with the matter.

The FDA could announce its decision as early as this week, the people said. The marketing denial order would follow a nearly two-year review of data presented by the vaping company, which sought authorization for its tobacco- and menthol-flavored products to stay on the U.S. market.

US to propose limiting nicotine levels in cigarettes

The Biden administration plans to propose a rule to establish a maximum nicotine level in cigarettes and other finished tobacco products in an attempt to make them less addictive, the White House Budget Office said Tuesday.

The rule, expected in May 2023, would be designed with the goal of making it easier for tobacco users to quit and help prevent young people from becoming regular smokers, according to a document released by the White House Budget Office. The proposal comes as the Biden administration doubles down on fighting cancer-related deaths.

Legalization of Cannabis May Have Caused Decreased Use Among Young Adults

The legalization of nonmedical cannabis use may be associated with the decreased use of alcohol, cigarettes, and nonprescribed pain relievers among young adults, a team of researchers in Washington state found in a recent study.

To understand how cannabis laws affected the changes in substance use other than cannabis, the researchers assessed a data sample from statewide surveys conducted from 2014 through 2019, totaling 12,694 respondents aged 18 to 25 years.

The researchers found that alcohol use and heavy episodic drinking had decreased, on average, after cannabis legalization. [...]

FDA's New Plan to Eliminate Most Nicotine in Cigarettes

The FDA plans to impose a product standard that would eliminate most nicotine from cigarettes, making them effectively non-addictive, and neutering the tobacco industry’s market power. The story was first reported last Friday by the Wall Street Journal.

The news wasn’t unexpected. The Journal reported over a year ago that the Biden administration was considering a revival of former FDA commissioner Scott Gottlieb’s “comprehensive plan” that included both mandated nicotine reduction and a menthol ban for cigarettes. FDA and Biden administration officials have so far not commented on last week’s WSJ story.

Mayor Todd Gloria signed into law Friday a bill that will stop the sale of flavored tobacco in San Diego .

The City Council approved the SAAFE Act, introduced by von Wilpert, to prohibit the sale of specified flavored tobacco and nicotine products in the city. It targets flavored tobacco and nicotine products that "appeal to children through candy and fruit flavors, as an attempt to hide the harshness of nicotine and as a direct attempt to appeal to a younger audience," von Wilpert said.
