FDA defends heightened review requirement for flavored vapes at Fifth Circuit

The FDA’s stricter review requirements for flavoured vapes are adding to the legal and public health debate over how reduced-risk nicotine products should be regulated. While regulators point to youth protection concerns, critics argue that overly demanding approval standards may limit adult smokers’ access to alternatives that help them move away from cigarettes. The case highlights a central tension in nicotine policy: preventing youth uptake without undermining harm reduction for adults. Regulation should be rigorous, but it should also reflect relative risk, consumer behaviour and the public health cost of keeping cigarettes more accessible than safer alternatives.
